{"id":5032,"date":"2021-10-21T10:15:52","date_gmt":"2021-10-21T08:15:52","guid":{"rendered":"http:\/\/icar.cnrs.fr\/dicoplantin\/?p=5032"},"modified":"2025-06-24T17:16:16","modified_gmt":"2025-06-24T15:16:16","slug":"generality-of-the-law-e","status":"publish","type":"post","link":"https:\/\/icar.cnrs.fr\/dicoplantin\/generality-of-the-law-e\/","title":{"rendered":"Generality of the Law"},"content":{"rendered":"<h1 style=\"text-align: center;\"><span style=\"font-size: 14pt; color: #ff0000;\">Argument of the GENERALITY OF THE LAW<\/span><\/h1>\n<p>In law, the argument of the <em>generality of the law <\/em>[1] states that the law must be applied in its entirety, that is, the law is not negotiable.<br \/>\n\u2014 We must not make distinctions where the law does not.<br \/>\n\u2014 General terms should not be given particular meanings.<br \/>\n\u2014 Most important: The law does not discriminate between persons: all subjects of law are equal before the law.<\/p>\n<p>This principle is enshrined in the Universal Declaration of Human Rights of 1789, Article 6, \u201cThe law shall be the same for all.\u201d<\/p>\n<p style=\"padding-left: 40px;\">The Constitution of the 5th French Republic, Article 1, states, \u00ab\u00a0[The French Republic] shall ensure the equality before the law of all citizens without distinction of origin, race or religion.\u201d<\/p>\n<p>A reminder:<\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\">Punishment of error does not avoid the great ministers, rewards for good does not overlook commoners<strong><br \/>\n<\/strong><\/span><span style=\"font-size: 10pt;\">Han Fei (~-283, -233),<em> Han Fei Tzi<\/em>, Section 6, \u201cOn having standards\u201d [2].<\/span><\/p>\n<p>Any possible exceptions must be explicitly stated in the relevant regulation. For example, while canna\u00adbis consumption is generally prohibited, it may be <em>tolerated<\/em> in some specific places that comply with existing regulation.<\/p>\n<p>In public places, people&rsquo;s behavior must conform to the <em>law<\/em> plus the specific <em>rules<\/em> of the place.\u00a0 When rules are strictly enforced, they also follow the principle of generality. If the school rule states in general terms that \u201c<em>the use of cell phones during class is prohibited <\/em>\u201d, then it applies generally, and does not allow for exceptions or distinctions.
