Argument from the Genus<\/span><\/h2>\n<p>This argument [1] is based on an essential definition.<span style=\"background-color: #ffff00;\"> It transfers the qualities, duties, representations,and all the characteristics associated with the <strong>genus<\/strong> to its <strong>species<\/strong>, and finally to the <strong>individuals <\/strong>belonging to this genus<\/span>, see <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/classification-e\/\">classification<\/a>; <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/categorization-and-nomination\/\">categorization<\/a>; <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/definition-and-argument-e\/\">definition<\/a>.<br \/>\nFrom a cognitive point of view the argument from the genus is the same as the argument from the category. From a linguistic point of view the argument from the genus is the same as the argument from lexical definition. Like the genus\/species argument, the relation hyperonym\/hyponym relationship transfers the characteristics of the hyperonym to the hyponym.<\/p>\n<h2><span style=\"color: #0000ff; font-size: 12pt;\">2. Extension to the Genus: the Generic Clause \u201c\u2026 <em>and<\/em> <em>the like<\/em>\u201d<\/span><\/h2>\n<p>Generic clauses are phrases such as \u201c&#8230; <em>and the things of the same kind<\/em>\u201d, \u201c\u2026\u00a0<em>and the like.<\/em>\u201d The text has the follpwing form:<\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\">This provision applies to <strong>a<\/strong>, <strong>b<\/strong>, <strong>c<\/strong>, and <em>things of the same kind.<\/em><\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\"><em>Universal Declaration of Human Rights, Article 2<a href=\"#_ftn1\" name=\"_ftnref1\"><strong>[1]<\/strong><\/a>.<br \/>\n<\/em>Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, color, sex, language, religion, political or other opinion, national or social origin, property, birth <span style=\"background-color: #ffff00;\"><em>or other status<\/em>.<\/span> (My emphasis)<\/span><\/p>\n<p>If an object <strong>x<\/strong> is not included in the enumeration \u201c<strong>a, b, c\u2026<\/strong>\u201d but can be considered part of the category defined by the enumeration, then <span style=\"background-color: #ffff00;\">the generalizing clause \u201c<em>and all beings of the same kind<\/em>\u201d<\/span> applies the provision concerning <strong>a<\/strong>, <strong>b<\/strong> and <strong>c<\/strong> to <strong>x<\/strong>.<br \/>\nThis shows that the enumerated beings are mentioned not only\u00a0 for their own sake, but also as prototypes from which a new category is to be derived, see <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/analogy-iii-structural-analogy\/\">Analogy 2<\/a><strong>.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\">This rule applies to cars, motorcycles, and <span style=\"background-color: #ffff00;\">all private vehicles<\/span>.<\/span><\/p>\n<p>Cars and motorcycles are regarded as prototypical members of the category \u201cpersonal transport\u201d to which the rule applies. Note that the particle <em>etc.<\/em> would also open the list to new subcategories of individuals, but would not indicate the relevant common feature that brings them into a particular genus, as the provision \u201c<em>all private vehicles<\/em>\u201d provision does.<\/p>\n<p>The generic provision may either create a new category from an enumeration of specific individuals, or it may explicitly mention an existing genus:<\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\">You must pay the tax on chickens, geese, <span style=\"background-color: #ffff00;\"><em>and other poultry<\/em><\/span>.<\/span><br \/>\n<span style=\"font-size: 10pt;\"><em>Conclusion<\/em>: the same applies to ducks and turkeys.<\/span><\/p>\n<p>Chickens and geese are mentioned only as prototypical examples of the category \u201cpoultry\u201d. One could discuss borderline cases,such as whether a peacock is really a backyard animal or\u00a0 pet. In any case, rabbits are not considered poultry and are not subject to the levy.<\/p>\n<p>However, the absence of a generic provision limits the application of the measure to the categories that are explicitly mentioned:<\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\">You have to pay the tax on chickens and geese.<\/span><br \/>\n<span style=\"font-size: 10pt;\"><em>Conclusion<\/em>: Not on ducks.<\/span><\/p>\n<p>Unless the <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/intention-of-the-legislator-e\/\">legislator&rsquo;s intent<\/a> is invoked.<\/p>\n<p>The use of the comprehensive clause is not limited to the legal field:<\/p>\n<p style=\"padding-left: 40px;\"><em>Fixed concrete grill<br \/>\n<\/em>Caution! Do not use alcohol, gasoline <span style=\"background-color: #ffff00;\"><em>or similar liquids<\/em><\/span> to light or reactivate the fire.<\/p>\n<hr \/>\n<p><span style=\"font-size: 10pt;\"><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Latin <em>ejusdem generis<\/em> argument.
