{"id":5327,"date":"2021-10-22T19:03:50","date_gmt":"2021-10-22T17:03:50","guid":{"rendered":"http:\/\/icar.cnrs.fr\/dicoplantin\/?p=5327"},"modified":"2025-05-10T16:16:53","modified_gmt":"2025-05-10T14:16:53","slug":"precedent-e","status":"publish","type":"post","link":"https:\/\/icar.cnrs.fr\/dicoplantin\/precedent-e\/","title":{"rendered":"Precedent"},"content":{"rendered":"<h1 style=\"text-align: center;\"><span style=\"font-size: 14pt; color: #ff0000;\"><strong>PRECEDENT<\/strong><\/span><\/h1>\n<p>The <em>argument from precedent<\/em> corresponds to the topic n\u00b0 11 of Aristotle&rsquo;s <em>Rhetoric:<\/em><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\">Another line of argument is founded upon some decision already pronounced, whether on the same subject or on one like it or contrary to it. (<em>Rhet<\/em>., II, 23, 11; RR, p. 365)<\/span><\/p>\n<p>\u201cJudgment\u201d refers not only to the sentence of a court but to any judgment or decision made in the past, in ordinary life as well as in the political or legal sphere. A precedent in any domain is an <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/example-e\/\"><em>example<\/em><\/a> to be follow, a model.<br \/>\nIf the matter has not been decided in a formal assembly, it may have been decided by such authorities as well-known <em>fables<\/em>, <em>parables<\/em>, <em>proverbs<\/em> or celebrated <em>verses<\/em> (Lausberg [1960], \u00a7 426).<\/p>\n<p>Judgments are made in the context of previous judgments on cases \u201cof the same kind\u201d, i.e., belonging to the same <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/categorization-and-nomination\/\">category<\/a>. Precedents correspond to a requirement of <em>continuity<\/em> and <em>consistency<\/em> between decisions made in the past and the decision to be made The structural coherence of the discursive field in question is thus strengthened, and protected against any <em>ad hominem<\/em> accusation directed against the institution, see <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/ad-hominem-2\/\"><em>ad hominem<\/em><\/a>.<\/p>\n<p>Like the argument <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/ab-exemplo-argument-e\/\"><em>ab exemplo<\/em><\/a>, the argument <em>from precedent<\/em> motivates a decision or interpretation by reference to data or examples drawn from tradition. It is a conservative principle, that limits innovation in all areas in which it is applied. As such, it combines well with arguments that appeal to \u201cthe wisdom of our forefathers\u201d (Bentham, 1824; see <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/political-arguments-eng\/\">political argument<\/a>; <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/authoritye\/\">authority<\/a>; <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/progress-e\/\"><span style=\"background-color: #ffffff;\">progress<\/span><\/a>.<\/p>\n<p>The precedent principle proceeds in the following stages:<\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\"><strong>(i)<\/strong> A problem, <strong>P1<\/strong>, a case to be decided.<\/span><br \/>\n<span style=\"font-size: 10pt;\"><strong>(ii)<\/strong> <em>Research into similar problems and cases<\/em>, leading to<\/span><br \/>\n<span style=\"font-size: 10pt;\"><strong>(iii)<\/strong> A categorization: this case is similar to a previous case <strong>P0<\/strong>; it falls into the same category as <strong>P0<\/strong>, see <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/analogy-iii-structural-analogy\/\">Analogy (II)<\/a>; <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/categorization-and-nomination\/\">Categorization<\/a><strong>.<br \/>\n<\/strong><strong>(iv)<\/strong> The decision, judgment, evaluation &#8230; <strong>E<\/strong> has been made about <strong>P0<\/strong>;<\/span><br \/>\n<span style=\"font-size: 10pt;\"><strong>(v)<\/strong> By application of the <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/justice-rule-of-e\/\">rule of justice<\/a>, a similar judgment must be made about <strong>P1<\/strong>. \u201cSimilar\u201d here means the same judgment, a judgment that is proportional, or opposite; or, more simply, a judgment that is consistent with <strong>E<\/strong>.<\/span><\/p>\n<p>The appeal to precedent can be blocked at the second stage, where it can be argued that there are substantial differences between <strong>P1<\/strong> and the previous case <strong>P0<\/strong>.<\/p>\n<p>The problem of judgment is automatically solved as soon as an analogy is drawn between the problematic fact and an established fact. Precedents save time and effort.<\/p>\n<h3><span style=\"color: #800000;\"><strong>Past Historical Facts as Precedents<\/strong><\/span><\/h3>\n<p>Not all past historical facts can serve as precedents; to function as such, they must serve as a common reference in a given present situation. In other words, past historical facts as precedents must be socially ratified, i.e., have a social <em>presence<\/em>, see <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/schematization-eng\/\">schematization<\/a>.<\/p>\n<p>Historical memory is full of such historical moments that serve as guides for action, either <strong>positively, as models, or negatively, as anti-models.<\/strong><\/p>\n<p>The extermination of Jews, Gypsies and homosexuals during the Second World War is now the exemplary characterization of what the world should <em><strong>not<\/strong><\/em> be, and a founding example for political thought.<br \/>\nFor the United States before the Iraq war, Vietnam was the basic analogical resource that was called to the rescue when it came to opposing military intervention abroad.<\/p>\n<p>Such events produce figures that are a source of <em><strong>antonomasia<\/strong><\/em>. Antonomasia is the figure of speech by which a member of a category is designated by the name of the paragon of that category. In 1938, French\u00a0 Prime Minister Paul Daladier and British Prime Minister Neville Chamberlain surrendered to Hitler at Munich. Now, their names are common name: A Daladier, a Chamberlain is a politician who capitulates to a dictator, the incarnation of what a politician should <em><strong>not<\/strong><\/em> do. By the same mechanism, to call a political conference \u00ab\u00a0a new Munich\u00a0\u00bb is to assume that it resulted in a capitulation.
