{"id":6499,"date":"2021-11-09T11:15:43","date_gmt":"2021-11-09T10:15:43","guid":{"rendered":"http:\/\/icar.cnrs.fr\/dicoplantin\/?p=6499"},"modified":"2025-06-13T17:34:21","modified_gmt":"2025-06-13T15:34:21","slug":"on-the-letter","status":"publish","type":"post","link":"https:\/\/icar.cnrs.fr\/dicoplantin\/on-the-letter\/","title":{"rendered":"Letter : Appeal to the \u2014"},"content":{"rendered":"<h1 style=\"text-align: center;\"><span style=\"font-size: 14pt; color: #ff0000;\"><strong>Appeal to the LETTER <\/strong><\/span><\/h1>\n<p>Latin <em>ad orationem<\/em>, <em>oratio<\/em>, \u201cspeech, discourse.\u00a0\u00bb <em>Ad litteram<\/em>, lat. <em>littera<\/em>, \u201cletter; writing.\u201d<br \/>\nBoth terms can refer to written or spoken speech.<\/p>\n<p><span style=\"color: #0000ff; font-size: 12pt;\"><strong>1. In law and regulations<\/strong><\/span><\/p>\n<p>The law is interpreted <strong>to the letter<\/strong> when its interpretation is limited to the text&rsquo;s<strong> literal meaning, <\/strong>see <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/strict-meaning-e\/\">strict meaning.<\/a><br \/>\nThis mode of interpretation is opposed to interpretations that <strong>appeal to the spirit of the law<\/strong> for example, by referring to the <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/intention-of-the-legislator-e\/\">intention of the legislator<\/a>.<\/p>\n<h2><span style=\"font-size: 12pt; color: #0000ff;\">2. In everyday argument<\/span><\/h2>\n<p>In everyday conversation, the term <em>to the letter<\/em> (ad litteram) refers to a second turn of speech based on what the other party has explicitly said (\u00ab\u00a0verbally\u00a0\u00bb), word for word, disregarding what the first speaker actually meant.<br \/>\nThis occurs with indirect speech acts, such as requests, softened as questions:<\/p>\n<p style=\"padding-left: 40px;\">S1: &#8211; Could you pass me the salt?<br \/>\nS2: &#8211; Yes.<\/p>\n<p>However, <strong>S2<\/strong> does not pass the salt shaker to <strong>S1<\/strong>. <strong>S2<\/strong> answers the letter, without considering that <strong>S1<\/strong>\u00a0asked him <em>to pass the salt<\/em> (to do something), not to comment on <em>his ability <\/em>to do so.<\/p>\n<p>In an argumentative situation, the term <em>ad litteram<\/em> refers to a response that strictly adheres to the opponent&rsquo;s literal words, without attempting to understand or answer the opponent&rsquo;s intended meaning:<\/p>\n<p style=\"padding-left: 40px;\">The police pfficer: \u2014 Just tell me So-and-so did it, and I will let you go<br \/>\nThe suspect: \u2014 \u00ab\u00a0So-and-so did it\u00a0\u00bb<\/p>\n<p>By repeating the police&rsquo; words, the suspect says\u2013exactly, but ironically\u2013what the police wanted him to say in order to be released.\u00a0 He answered the letter, but he probably won&rsquo;t be released.<br \/>\nThe type of reply addresses the <strong>word and phrase litteral meaning<\/strong> rather than <strong>the speaker&rsquo;s intended meaning<\/strong>, i.e. the spirit or intent of the police, given the conversational context.<br \/>\nThe suspect fulfills his turn of speech, and gives the floor back to the accuser, who must rephrase what he wants to say.<\/p>\n<p><strong><em>Ad rem<\/em> and <em>ad litteram<\/em> arguments.<\/strong> An\u00a0argument on the merits (<a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/ad-rem-eng\/\"><em>ad rem<\/em><\/a>, to the matter) deals with the fundamentals of the case. Such\u00a0arguments\u00a0 are based on a methodical and exclusive exercise of reason (<a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/ad-judicium-eng\/\"><em>ad judicium<\/em><\/a>).\u00a0 An argument <em>to the letter avoids<\/em> the issue by dealing only with its formal expression.<\/p>\n<p>This strategy can be used as a <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/orientation-reversal-e\/\">disorienting<\/a> move, that serves a <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/destruction-of-speech-e\/\">destructive<\/a> purpose. It bypasses the significant content of the intervention by focusing on the fom of the speech. It can even turn <strong><em>the letter<\/em><\/strong> of the speech against <strong>the speaker&rsquo;s intention.<\/strong><\/p>\n<p>This maneuver contrasts with a charitable consideration of the intent of the discourse and does not seek to take advantage of a poor formulation. In other words, it does not consider the conversational context.<\/p>\n<h2><span style=\"font-size: 12pt; color: #0000ff;\"><strong>3. A Complex Case<\/strong><\/span><\/h2>\n<p><span style=\"font-size: 10pt;\"><strong>\u2014 SITUATION<\/strong>: A dispute about the legal and ethical management of science funding<\/span><\/p>\n<p><span style=\"font-size: 10pt;\">1) Research in domain <strong>B<\/strong> is subject to legal provision <strong>S<\/strong>, which prohibits research that could lead to extremely dangerous results of type <strong>U<\/strong>.<\/span><\/p>\n<p><span style=\"font-size: 10pt;\">2) A research group submits a research project in domain <strong>B <\/strong>to institution <strong>I<\/strong>. The research objectives are defined in the research proposal that accompanies the funding application. Funding is granted.<\/span><\/p>\n<p><span style=\"font-size: 10pt;\">3) This research produces a result, <strong>X<\/strong><\/span><\/p>\n<p><span style=\"font-size: 10pt;\"><strong>\u2014 CLAIM<\/strong>: Result <strong>X<\/strong> is a type <strong>U<\/strong> result. <strong>R<\/strong> conducted <strong>U<\/strong>-type research, and <strong>I<\/strong> actually funded <strong>U<\/strong>-type research. Both knowingly violated the law.<\/span><\/p>\n<p><span style=\"font-size: 10pt;\"><strong>ISSUE:<br \/>\n<\/strong><\/span><span style=\"font-size: 10pt;\"><strong><em>Does this research violate the statute prohibiting research likely to lead to U-Type results?<\/em><\/strong><\/span><\/p>\n<p><span style=\"font-size: 10pt;\"><strong><em>\u2014 <\/em><\/strong><strong><em>ANSWER NO<\/em><\/strong><strong>:<\/strong> Appeal to the letter (strict meaning) of the research project.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\"><strong>NO<\/strong>. <strong>U-type research<\/strong> <em>emerged<\/em> <em>unexpectedly<\/em>.\u00a0The terms of reference did not include any research likely to produce\u00a0<strong>U-Type<\/strong> results. <\/span><span style=\"font-size: 10pt;\">Such unexpected occurrences are common in scientific research.<\/span><\/p>\n<p><span style=\"font-size: 10pt;\"><strong><em>\u2014 <\/em><\/strong><strong><em>ANSWER YES<\/em><\/strong><strong>:<\/strong> Intentional interpretation, see <a href=\"https:\/\/icar.cnrs.fr\/dicoplantin\/motives-and-reasons-e\/\">motives and good reasons.<\/a><\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\"><strong>IT DOES.<\/strong> <strong>U-Type results<\/strong> did not \u201c<em>emerge<\/em>\u201d,they were intentionally produced.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\">(1) According to our panel of top scientists, a competent researcher could have foreseen that\u00a0 <strong>U-Type<\/strong> results would follow from the objectives defined in the specifications.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\">(2) The terms of reference don&rsquo;t explicitly refer to <strong>U<\/strong> as a goal of the research in order to avoid the obvious legal and political consequences.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\">(3) However, the research proposal describes work that conforms to the generally accepted definition of <strong>U<\/strong>, and meets the criteria for\u00a0<strong>U-Type<\/strong> research, according to distinguished members of the relevant scientific community.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-size: 10pt;\">Conclusion: They had a hidden agenda. They intentionaly conducted <strong>U-Type<\/strong> research, regardless of whether they used that term.
