Rem<\/em><\/strong> est l’accusatif du substantif res<\/strong>\u00a0<\/em>qui signifie :
\n1) \u00ab objet, \u00eatre \u00bb ;
\n2) \u00ab affaire judiciaire, litige \u00bb (Gaffiot, Res<\/em>).<\/span><\/p>\n

1. Dans le premier sens de res<\/em>,<\/strong> l’argument ad rem<\/em> est un argument qui s’attache \u00e0 \u201cla r\u00e9alit\u00e9 des choses\u201d. C’est sans doute dans ce sens que Whately assimile l’argument ad rem<\/em> \u00e0 l’argument ad judicium<\/em><\/a> de Locke.<\/span>
\nDans une perspective essentialiste, on peut aussi comprendre que l’argument ad rem<\/em> est celui qui porte sur l’\u00eatre<\/strong><\/span> des choses.<\/span><\/p>\n

2. Au sens de \u00ab affaire judiciaire, litige<\/span>\u00a0\u00bb<\/strong> (Gaffiot), <\/span>[res<\/em><\/strong>] renvoie nettement \u00e0 un d\u00e9bat, comme dans les expressions nihil ad rem<\/em><\/strong> \u201cce n’est pas la question<\/em>\u201d et quid ad rem\u00a0?<\/em><\/strong> \u201cqu’importe ?<\/em>\u201d. Ces expressions servent \u00e0 rejeter une intervention comme sans pertinence<\/a>.<\/span>
\nEn ce sens, l’argument ad rem<\/em> est un argument qui s’appuie sur un fait [res<\/em>]\u00a0pertinent pour la cause [causa<\/em>], sachant que certains faits li\u00e9s \u00e0 l’acte mat\u00e9riel donnant lieu \u00e0 un litige peuvent ne pas entrer dans la cause. <\/span>
